My builder left what I consider to be a large amount of bricks and tiles and other rubbish under the ground in the backyard. We only found these when we started landscaping. After removing a few wheelbarrow loads ourselves, I decided to ask the builder to remove the rest, based on the contract saying the builder is responsible for "Removal of all Builder's debris from construction of home" (my emphasis).
But my builder (Big M) has refused to remove it, saying that there isn't much there and therefore they will not remove it. They also said that the debris is probably underground because there was rain during construction of my house (and in 9 months of constructions, why would there not be rain?), and because a bobcat probably ran over it and pushed it into the ground.
I am claiming that they should not have allowed the debris to get underground in the first place, and should have removed it first. I'm also claiming that it doesn't matter if they think there isn't much there, because they should have removed all of it.
Has anyone had any similar issues? How much debris do you think it is fair for the builder to leave behind?
