Browse Forums Building Standards; Getting It Right! 1 Apr 03, 2011 9:17 am We have been in our house for a couple of months now and since moving in we have found a number of problems, walls aren't straight, plaster joins very visible on ceilings and walls, can see a lot of the patches in the plaster where the nails are, there are gaps between the window frames and plaster, plus a heap of other stuff. The question I have is in regards to getting this stuff looked at by our builder and getting them fixed. I have read through the standards and tolerances guidelines and some of the stuff is either on the border line or out of the tolerance. Being that we have accepted the house as it is, does anyone have any ideas of what we might be able to do to get our builder to rectify these issues? I am going to request a copy of the final quality inspection from our builder (don't know if they will give it to me), I was also thinking of getting an inspector in now to measure everything and do a report. We are really unhappy with so many aspects of our house and I can't help but feel ripped off. Any thoughts or suggestion would be greatly appreciated. Re: Getting problems fixed after sign off and after moving i 3Apr 04, 2011 9:55 am This is what I am worried about, I have already spoken to our CS about these issues and he told us that because we have accepted the house that we will not be able to pick these issues in our maintenance inspection. Although we weren’t rushed through our PCI, we were rushed to get out of the rental we were in and so because of a few delays we had during the build, we had no choice but to accept the house in its current state. Our mistake for being rushed to get in, but I still think that they let things pass that should have been fixed. I should also add that our builder was well aware of the fact that we needed the keys by a certain date, we never put pressure on them to hurry up (despite the delays), but did say to them that we needed the keys by a certain date. There is also something called an Implied Warranty which means regardless of what you might have signed the builder has the legal duty to do a proper job with reasonable care and workmanship. I'm with bashworth, in that your CSC is not correct with that statement. Referring to my contract with PD, there is a clause that states, if the owner gives the builder a list of known defects and incomplete work the builder must carry out the work required to rectify any defects or to do any incomplete part of the building works for the building works to reach completion. Further, the fact that the owner pays the final claim is ot evidence that there are no defects or incomplete work nor a waiver of any rights under a statutory warranty. and further still, the fact that the builder signs the list is not an admission that the defects exist or there is incomplte building works. The onus is on you, however, to provide IN WRITING WITHIN 3 MONTHS of handover all the known defects that are noticed post handover. The builder must then respond with in a certain time frame to rectify as soon as reasonable practicable. Always refer back to your contract so that you are well prepared in case your builder breaches any clauses in the contract. However, be mindful that you to, as the owner, have certain obligations to fulfil throughout the contract as well.
