Browse Forums Building Standards; Getting It Right! 1 Mar 08, 2011 8:28 am Hi we have finally moved into the new house! And yes, we have some issues with the property. Our contract was with a development firm who then hired the builder to complete the work. My question is do we take our complaints to the development company or to the builder? Secondly, although it is not specifically included in our contract I was expecting the builder to include toilet roll holders and towel rails? Was this wrong of me? Thanks Re: Off the plan settlement questions 2Mar 08, 2011 3:22 pm Legally you can only take your complaints to the people you have the contract with. Generally we have always provided our own toilet roll holders and towel rails separately. It doesn't cost that much and you select the ones you like. regards The Harder You Try - the Luckier You Get ! Re: Off the plan settlement questions 3Mar 10, 2011 12:12 pm I wouldn't expect toilet roll holders and towel rails to be provided. You get what's in the contract, nothing more and nothing less (except as required by building codes, council by-laws, etc etc). As for question 1, you've got a contract with the development firm, so they are responsible for providing you with what's in the contract. The builder has a contract with the development firm, not with you. So if you take the issues up with the development firm, they have the option of chasing the builder or fixing things themselves. You can't really control which one they choose, they are responsible only for fulfilling their contract with you, not for the way in which they fulfill it. I gave the builder a ring anyway, he came over yesterday to have a look and rang his plumbers/painter/electrician to come and fix the majority of the minor suff. regarding the major stuff he said it could t be done so I will start drafting a letter to the developer regarding the one major issue. having built in different rural locations may i suggest that the house should suit the location and needs to be different from homes in town..eg if you will be working… 9 5016 I couldn't attached the photo for some reason.
