Browse Forums Building Standards; Getting It Right! 1 Jan 15, 2011 9:21 pm Hi all. My site works for my new home have just been completed. An existing neighbour who has given me nothing but trouble with my building is at it once again. My builder called me today stating that the neighbour had just called them saying that no one is to access his land to connect power and if they do he will charge them with trespassing. The Western Power dome is behind his front fence which is a brick wall and this is the dome that I need to connect to. I would not think he could deny such access - it is not his dome to dictate and I am wondering if it is even lawful that he has it behind a fence. The developer of the land is going to sort this out but I am just wondering if anyone else has experienced this and how you got around it? Thank you in advance. Re: Building and Western Power Dome Access 2Jan 16, 2011 1:17 am I thought they were put in front of the property boundary, so their wall could be too far forward. maby check the boundary pegs. if the wall is too far forward and he's not cooperating still, threaten to call up the council to get the wall knocked down. hopefully he just cooperates and stops being paranoid about people in the front yard. Re: Building and Western Power Dome Access 3Jan 16, 2011 12:46 pm Legally, Western Power have the right to access any power dome no matter where it is on a property. Kind of like a sewer easement. The neighbour is just being a PITA. This would have been pointed out to him if he put his fence plan through council which isn't likely if he thinks he can play silly buggers. Re: Building and Western Power Dome Access 4Jan 16, 2011 2:25 pm Thanks for your replies so far, they confirm what I already thought. Whilst he may be able to deny access to the builder - he cannot deny access to Western Power, so if they come in to do the power feed then it should be ok.. However I am not sure if Western Power will actually do that.. I think his wall must be illegal, at least in the sense of that the power feed form the road would have to pass under it which would seem to be as an obstruction should Western Power ever have to work on it.. Re: Building and Western Power Dome Access 5Jan 16, 2011 4:20 pm The Western Power dome will be in an easement - your neighbour doesn't have the right to build over it or on it or refuse access for purposes of connecting you to power. He may well find himself ion court on serious charges if he persists with his current actions.
