I am a next door neighbour of a new house that is being built by supposedly Victoria's leading builder
The neighbours have been persistently claiming that they need to remove the fence to brick the garage wall that is proposed at 150mm from the boundary. We haven't provided our consent, namely as we have 2 small children and a dog (with absolutely no road sense). They have excavated to the fence line at a depth of around 900mm, so if one of the kids fell down that, the outcomes could be catastrophic.
Anyway all had gone quiet lately and we assumed that they'd come to their senses and worked out a way to do it without removing the fence.
But no - today at 1pm I get a voice mail message from Metricon - just a courtesy call mind you - confirming that they would be removing the fence tomorrow morning.
What should I do - any advice? And what about the lack of notice - is this acceptable?
