(we hope) Throughout the planning process one of the main goals of our build was to have a nice ensuite. On this we selected a 1810ml bath, prior to any plans being drawn. The bath size and style was reconfirmed at pre selections and the plans have a 1810ml bath in the ensuite. All walls, and now roof have been completed and we just received a call from the building company to say that due to an error in drafting the bath we selected will not fit. The width of the room is 1810ml, so it can not fit a 1810ml bath. Apparently the draftsman referred to the wrong size bath, expecting a much smaller on to be installed. even though in the plans he has written 1810 bath? Now the questions I want to know is where do I stand in what is their mistake. Basically the company have stated a much smaller bath will fit, and they will re imburse me the difference in cost of the baths. That is it!! Both my wife and I are very dissapointed, and at least would have expected some apology and reconcilliation package. Am I entitled to refuse the smaller bath, and either 1. Request they install the 1810ml bath (moving walls etc.), or 2. Install a smaller bath after we have reached a suitable compenstation package? They are trying to strong arm me at the moment to sign the variation agreement, but I am not sure where I stand? Thanks in anticipation of a reply O Re: Advice Needed. Eg/ upgrade fittings/tile higher or something like that. You are still entitled to option 1, but it depends on how much sh*t/delays/bad blood you are willing to put up with. I think a compromise solution would be best at this point. I have picked up some minor issues with my build that I've picked up via 'unauthorised' inspections. I figure I'm doing them a favour seeing I pick it up early and save them money. Have you been checking out the house regularly? Re: Advice Needed. Perhaps just tell them you're requesting the walls be moved and the bath be made to fit. If they argue, just say, well unless you're going to offer something thats similar value to you, than thats all you'll accept. As far as "Unauthorised inspections" just ensure that you have a white card (Well thats what they call it in QLD). If they catch you onsite without one, they have every right to hold it over to you. If you have a white card (Which is a 20Min online quiz and $80), then you should be legally allowed on any building site, as long as you have permission or the land is owned by you. All advice given in the above post is purely an opinion, and should always be checked with the appropriate official department of council or law.
