We have almost reached lockup stage, with the roof almost complete, bricks completed and the doors and windows are in. The roof in the master bedroom is not yet complete and it is currently raining inside of the bedroom. We have been pushing to get the roof completed for quite a while but there have been significant delays with bricks (we needed to have part of the facade constructed prior to the roof being completed) and the with getting tradies back to complete the roof. A temporary covering has been placed over the gap in the roof but it is leaking enough for there to be a large puddle on the floor. I'm concerned as our SS is keen to start plastering this week before the roof is complete and before the frame has had a chance to dry out. Our SS has stated that the house has reached lockup stage. Can we withhold payments until the roof has been completed? Re: Roof not complete - what are our rights? 2Sep 07, 2010 10:01 pm Read your contract for lock up definition, you need to go by that. The building contract I signed definitely states that roof covering is part of fixed stage. If your contract is the same, I would be withholding fixed stage payment if a large section of roofing is missing. Email your CSC ASAP (ie, dont wait until the day its due!) advising that you believe fixed stage isn't complete due to what you have described and that you intend on withholding payment until its completed properly. Put it all in writing and you should find that there are no issues. Did you express your concerns during the lockup inspection?
