The fiasco started here ...<https://forum.homeone.com.au/viewtopic.php?f=21&t=35348&start=20> ...and is seeming like an ongoing saga when the final straw today was the builder's wife yelling that 'they' don't need any stress in their lives because I had the audacity to ask for a receipt for the slab invoice...which I paid on 21st June (a whole month ago). When I said I'd been trying to get in touch with her husband due to an error (on his part) in the fascia order yesterday, she became very agitated and while trying to coerce me into changing my mind about the colour I've chosen, said I'm very lucky they give such a great choice in colours etc. Heck they don't even have a full range of samples and to be honest I am certain this is what caused this latest problem. Never mind that the kitchen window is in the wrong place and I was told that I don't need wall cabinets in the kitchen (nobody ever uses them anyway!) and I should just delete them from my kitchen plan. Not to mention the visible vanity waste! This builder doesn't have a selection process in the early stages like so many of you have had, and while I thought it would be an easier process I'm now beginning to question their decision, although it must be said that 'proper' recording of selections etc is a must, not relying on memory when they return to the office. Sorry for the lack of details but I just typed a whole report on today's latest and it's zipped off into cyberspace and to be totally honest I feel quite drained and don't have the energy to retype. Just wondering if there are any H1 members in NSW who have cancelled their building contract during the build? I've been in touch with Fair Trading who referred me to Law Access and they will assess the situation and get back to me tomorrow. While typing this, the builder phoned and asked for an onsite meeting at 9am but I am expecting he will want to smoothe it over yet again as the last meeting didn't really reach a satisfactory resolution either...the subject gets changed and the conversation is left up in the air. This is becoming all too regular and while I don't have anything against social chit chat, the building (and problems) should be discussed first. The lack of tradies has me wondering...the slab sat for three whole weeks before chippies could be found to stand the frame, now it appears the brickies have gone walkabout. Maybe the stress was too much for these blokes too? Unfortunately here comes another sleepless night, this is becoming habit forming! In the past a couple of members have also taken over their builds from builders that were struggling or in financial difficulties. . We were lucky that the home was 90-95% completed when we started hearing whispers. We spoke to one director who confirmed that they had run out of money and were unable to complete any jobs without securing more funds from their Bank (which as we all know is never guaranteed plus would take way too long) whilst the other director tried to convince us to stay with them and pay them the outstanding invoice. Needless to say that a two hour conversation with my husband - who is a very hard task master - convinced the director that they were better off letting us out of our contract. Plus deep down they were really nice people, the contract was due to expire on the day of the meeting and the fact that I was 7mths pregnant probably appealed to their better natures. They let us out without any further payments and signed documents to that effect which meant we weren't then entangled in the bankruptcy hearnings that took place the following fortnight. At the end of the day I don't know whether you can do anything if they are still working within the contract you signed. Any discrepancies can still be fixed as long as they don't go over their time frame as set down by contract. Some things are worth waiting for.
