Browse Forums Building Standards; Getting It Right! 1 Dec 11, 2009 10:45 pm Over the past month or so since my neighbours builder started building, we have consistently gotten more and more crap dumped by them on our property. Piles of broken concrete, general rubbish ( bottles, cans etc) broken tiles, bits of wire and plastic, bricks, and large washouts from the concrete truck they drove onto our property to lay the slab. I have spoken several times to the site supervisor, and he has been lovely to talk to, but hasn't yet done any of the "site cleans" that he has promised us. We are planning to start building in the next month, and my builder wants our permanent fence up prior to building so that we only have 2 sides that we need to put temporary fencing around (corner block). I negotiated ages ago with the neighbours that the fence would go up over christmas, but their temporary fence is a metre into our property at the moment, and the builder/supervisor is refusing to take responsibility for moving their temp fence so that the fencer can put up the permanent fence. They are saying that because of the cut they did on their side that a retaining wall needs to to be put in and they aren't sure who is responsible for putting that in?. It seems to be mainly fill from the cut that is spilling over the property line ( their land is higher than ours) but this in turn makes it difficult for the fencer too as the property line has ben raised artifically if that makes sense... Anyhow -before I make this into a novel... I no longer know what I should be doing to get something done about this - what rights do I have etc. I don't want to make a fuss for anyone - certainly don't want to start off on the wrong foot with my neighbours as I don't think it's their fault, but I want my block cleaned and my fence in without any issues / delays! I certainly don't want this to delay my own build. Any advice would be great!!! Not sure what my next move should be... Regarding the retaining wall, if they cut, they need to retain. The engineering report send to council should show whether a retaining wall is needed. I needed one on the side I didnt cut, I just used concrete plinths under the fence, which is a cheap option. Re: Builder next door messing up my block - My Rights? 3Dec 12, 2009 1:54 pm The builder isn't paying for the fence and has quoted for two sides temp fencing - it's up to me to organise the fence being built ( I am not going with a volume builder). We are just building a capped paling fence, the block is over quarter of an acre and our build will be 8 metres from the fence line, so I'm not worried about damage. I guess I just want to know what rights I have considering this temp fence is so far over into our property - I mean that alone is wrong.. isn't it? Shouldn't they have to move it back to their side or at least to the actual property boundary?
