My thought was to get rid of that blot on the landscape and hook your house up to a really noisy generator instead. Isn't that what the DA process is for.... so people can lodge objections? I am also trying to get my head around this... Our plans were approved in 2006 and he bought the place as an investment property a year or so later. The DA plans do not have any indication on them re poles anyway, we checked EVERY piece of paper but Energy Aust has had to approve it and there are no avenues for neighbours to have a say. He is giving us grief because "it is ugly and is devaluing his house" One has to wonder if HE is DEVALUING YOUR property by being a not so NICE neighbour? Would I buy your house with such knowledge of your neighbour. I think NOT. (nothing personal just making a point ). Edit- PS- My balcony problem is nothing compared to yours. Your forum came up in a google search I was doing on private lines in Vic - interesting reading so I had to join! I'm a sparky and I regularly deal direct with Energy Safe Victoria regarding private poles and electric lines and have received many exemptions to the state regulations for situations out of the ordinary. Just for a bit of info, if you go to this page: 5.2 Underground or overhead service connections http://www2.energyaustralia.com.au/inte ... S1+CIA.pdf It gives info about connections - "The standard connection in overhead mains reticulated areas is via an overhead service line however, an application may be considered for an underground to overhead (UGOH) connection under certain conditions as detailed in the NSW Service and Installation Rules." then after a whole heap of other stuff it concludes with: "Note: Where neither of the above methods of supply is suitable contact the local Customer Service Office." Hasn't helped in the past but worth trying again before you take it further. In my opinion it's up to them to replace their pole - not yours. It has splints so it's obviously partly rotten and will eventually need replacing - that's why they splint them. They love an pportunity to have a desperate customer pay the cost of replacing their assets and they'll always offer you that first to save their money. Put it back on them and don't budge! But I'd simply apply for an underground connection again on the grounds of improving the safety and outlook of your property - get a written response. If they grant it, then you get rid of your pole..win/win. There's your man - I'd ask them to provide an exemption (to the current state regulations) to either allow 1: an underground connection to the splinted pole; 2. ask them to force Energy Australia to replace the splinted pole because you are concerned about the safety of it; 3. or allow an overhead connection directly to your house but on the side close to the front as opposed to the very front. They are the only ones who can grant such an exemption as is Energy Safe Victoria where I live. Alternatively if all that fails, give a copy of all your responses to your neighbour with a covering letter stating that all future correspondance regarding this matter will be ignored. If he is concerned about the value of his property it will only effect him when he plans to sell...who cares what the value may be before then. Bonus if he sells - problem solved (not that the pole is your problem anyway). If he doesn't sell then you've done all you can and it won't take much more than a letter and a UG supply request to exhaust all avenues available to you. Don't waste your time with a solicitor - let the governing bodies sort it out for you. At the end of the day if your pole stays, put an Aussie flag on it and enjoy your castle!
