A house that is being built on the adjoining allotment is proposed to have habitable room windows (for bedrooms) setback 1.2 metres from our boundary. However there are eaves with concrete tiles that will be setback 60cm from the same boundary. Reading Reg 85 (see below), I have assumed (I could be wrong) that due to the eaves there is not 1 metre dimension clear to the sky: "A habitable room window of a building on an allotment must face— an outdoor space or light court with a minimum area of 3 square metres and a minimum dimension of 1 metre clear to the sky, not including land on an adjoining allotment". Also 'clear to the sky' in relation to an area means an unroofed area or an area roofed with a material that transmits at least 90% of light.
