Was seeking your expert guidance /advice on the following situation.
I am building in the western suburbs of Melbourne and close to the final handover of the build. Some background:
a). The build is on extremely reactive clay soil
b). Waffle slab on P class soil
c). Corner house with the neighbour’s property sitting at a height of approx. 600 mm.
Now the issue is that my garage wall sits on the title boundary and is approximately 400 mm below natural ground level. The weep holes are blocked by landscaping and DPC is sitting below ground level. The builder has not provided any retaining walls or drainage.
Please see the images provided.
1. Is the build non-compliant?
2. What can we do to avoid future water damage?

looks like a bit of a problem, needs to be dug out, and waterproofed. Was is designed as a retaining wall? It should have been since it was built 400mm below ground. The garage can’t be lined easily either or you could be obscuring termite entry or water damage.
Structurally should be ok but a brick wall is not the same as a retaining wall...

New twist now! The builder has now come back saying that it's not his fault as the adjoining neighbor has his built on a higher level, so it's basically his fault and responsibility to manage the water and soil slopping into our garage. The fact is that when our slab was poured our level was lower than neighbors. So the builder was aware of this fact but never told us that there would be potential water damage. Isn't this part of builders code to make their client aware of such issues? It could have been rectified earlier by installing retaining walls, AG drains but now I'm out of options 😞

is waffle pod slab even allowed on E class soil???
I would say this is pretty much a crime on spot to specify waffle pods on E class.
And yes, you would certainly need to slope away from footings and a proper drain there.
Remove the path, slope away from the footings, put a drain (with a grate) at around 1 m away from the house (roughly in the middle of the path), reseal it. Or this path belongs to your neighbour? Then it is really difficult situation.
If it has been designed as retaining wall, was it waterproofed and was the agg. drainage put in there? Is it only your garage or the whole house is sitting over?
What happens with the water/moisture getting inside this brick wall, I wonder?
