Browse Forums Windows & Doors 1 Sep 12, 2011 5:14 pm hi all, Could anyone give some advise on the following; I engaged a builder to renovate my bathroom, laundry and toilet room - in the process various paintwork in hallway + doors + door frames has been damaged and carpet in the hallway and living has been damaged. This is outside of the contract for renovation. I have handed the builder an building inspection report for defects to be rectified. He states that painting and carpet cleaning (he has "cleaned" the carpet 3 times but it is still marked and has grout residue in it) lie outside of the contract therefore he is not responsible for it. QUOTE : "Painting and Paint Preparation are not part of the contract and therefore these items are not covered by our contract. Whomever performs your painting and paint preparation is to paint these items." as for the carpet damage, QUOTE "The carpets are not identified in the report and *other builder who did defect report* confirmed that we can not be held accountable." I quite simply don't understand how he can cause this damage and not make good/return the items to their original condition prior to the renovation. this is also in contradiction to the advice that I got when I called the dept of Fair Trading this afternoon -DOFT said we could hold the builder responsible for consequntial damage. what can I do? ask him to pay/contribute to the cost of painting/cleaning.... many thanks GF Re: Damage to carpet & paintwork during reno by builder 2Sep 13, 2011 10:33 am I wouldn't pay him until those items are rectified or at least get a quote to fix them and then deduct that from the total. As an ex-builder, we used to take a lot of care working in peoples homes when we did an internal renovation using lots of drop sheets and old carpet strips taped to doorways to prevent this sort of damage. Get their advice before withholding payment. State your case and follow their advice. As for the builder, if he or his subbies did the damage then they are responsible, it's that simple.
