I place an order and paid a $1400 deposit in October last year and still do not have a confirmed installation date of when my windows will be installed. The windows maker initially blamed the PVC extrusion supplier claiming they ran out of material in Australia which took 5 months to get in. The last 6 weeks delay is apparantly due to the availability of the window fitter. The original advised time to install when I placed my order was 4 to 6 weeks. I was quite excited to have the PVC Double Glazed when I viewed them in the showroom, but due to the long wait I am now totally over them and sick of getting fobbed off by my window maker. Is there any consumer law that allows me to cancel the order and get my deposit back based on the Window Maker not being able to provide their product in the timeframe that they originally advised? Magee Re: Waiting six months for Double Glaze PVC Windows 2Apr 16, 2010 10:24 pm With the delay time frame you described you have plenty of right of cancel the order and ask for refund as they are not able to keep their part of the contract. You have also allow more than plenty of reasonable time. Best to send them a final letter (if not already done so) stating that if you do not get your windows by x date you will be canceling the order and request a refund. This way when you contact consumer affair you can prove that you have given them the opportunity to supply the items. If they argue, write to them, first ask for your money back, second give them a week to install, which is plenty of time if the windows are ready. Deposit was paid on credit card, but I think even the bank cant help because the transaction is older than 90 days. I found out that the company that was making my windows has gone into liquidation. All is not lost though as the person working with the appointed administrator has advised they have located my windows but they not assembled. They will contact another window maker to see if they can finish them off and I pay the difference to the new window maker. Warranty issue also crossed my mine but I have to weight up losing $1400 with no gain or spending more money to get my windows with a small risk. I would try to get money back and go to another supplier. To be honest, I think get some more quotes. Don't tie yourself to this deposit as it may cost you more in the long run.
