Although it is incidental to the non compliance, I wouldn't be too happy with the path's surface finish either.

It's certainly more course than I was expecting, and a departure from the finish of the original driveway. Although I wasn't sure I had much ground to complain if all that was described was "plain concrete". Afraid that ship may have sailed by now.
Consumer affairs has advised me to take it straight to VCAT as a goods and services claim (rather than via DBDRV for a building dispute). I've also recently reported him to VBA for infringements of the Contracts Act, as I advised him I would.
