Browse Forums Paving & Concreting 1 Feb 21, 2011 4:25 pm Hi there, We live in the Perth area and purchased some 40mm limestone pavers for our patio. When our tradies (who work for a reputable builder and have years of experience) tried to lay it, the pavers just broke apart into pieces when cut. Upon closer inspection, we noticed that the whole pallett's worth is full of hairline cracks. My husband was able to break pieces off with his bare hands. We phoned the company and the owner first argued that nothing could be wrong then he inspected them and said, "well maybe 10 or 15 have cracks, but the rest are fine." The paving guys and my husband dispute this. We can see cracks running throughout the lot. And the pavers are different thicknesses... Long story short, the company is refusing to refund us the money we paid for the pavers. We don't want anymore of his product if this is what it's like...but he is adamant that it's not his responsibility. Last time we talked to him, he said he's going to keep 70% of our money, refund us 30% and charge us to have them removed from our property. We're going to be out hundreds of dollars, plus the costs of buying replacement pavers from another source. Do we have any recourse? Hubby is checking into WA Consumer Protection...is there anyone else we should be contacting and following up with? Thanks for any advice. Re: Recourse re: bad pavers? 2Feb 22, 2011 3:46 pm That is shocking! Surely if the owner is confident in his product he should take them back and refund you the money (perhaps minus the delivery cost) Who did you buy them from? I may need pavers in the near future. Don't give up. Act quick. You may find the company has sold the same pavers to many others who also have complaints. The company may be trying to buy some time before legally closing down business. Re: Recourse re: bad pavers? 3Feb 22, 2011 7:33 pm I won't post their name publicly obviously, but if you PM me, I'll let you know. The story gets better...the owner said he'd refund us $250 on an $834 order...nice. He still contends that there were just a dozen or so that were bad...I took photos of a lot more than that and this is just the ones that were easily visible on the pallet. We phoned the Department of Commerce and under the new legislation (from this past January), as consumers, we are protected by law from buying defective products. So, we have sent the company a letter, Cced it to the Dept. of Commerce (who are already aware of the issue and said we have grounds for a complaint) and if we don't get resolution in the next 10 days, then we file a formal complaint with the government and it goes from there. Here's a couple of pics of the pavers: http://img.photobucket.com/albums/v504/Japonica15/IMG_5194.jpg http://img.photobucket.com/albums/v504/Japonica15/IMG_5188.jpg http://img.photobucket.com/albums/v504/Japonica15/IMG_5195.jpg http://img.photobucket.com/albums/v504/Japonica15/IMG_5201.jpg Appreciate that Chippy.
