Bathrooms and Laundry

One year ago, we bought a 3 year old house built by H*N*LY. For some reason there is water damage in all three toilets upstairs. We first noticed this in the ensuite, then later on the other two toilets upstairs. We called the builder, and they are sending out an inspector. I'm not too optimistic about what they are going to say. I almost expect them to claim no responsibility. How can I convince them to take responsibility?
We had a professional opinion a few months ago from another builder telling us that H*N*LY doesn't membrane their tiles, and this is the result of all our shower areas leaking. Does anyone know if I can call H*N*LY on this? Is membraning tiles essential when tiling toilets, or is it not a requirement?
My issue is that now I have stains on the ceiling downstairs!
Please let me know if you have any advice...

I really don't know, but I would be very surprised if membraining isn't a requiremnt of the BCA (Building Code of Australia) and therefore mandatory.

The standards require the floor and wall areas of all showers to be waterproofed, but not W/C's. If there is a leak coming from the toilet, you could go them for not connecting the toilet properly, but not for not waterproofing.
If the leak is coming from the shower area due to them not waterproofing it, then they are in the wrong as the law requires them to waterproof.

FYI...The inspector just saw everything and agreed that there needs to be work done to the toilets. He already scheduled someone to come out and do the work as early as this week. I'm glad we didn't have to convince him of their responsibility in this matter. My husbad reckons that they have seen this sort of water leakage too often with their houses. Whatever it is, it is not coming out of our pockets.

Good news... that is about them paying.. not about the problems with the toilets.
