I think they have ripped me off and I am wondering whether to fight it at Tribunal or not. here's the GO. The A/C supposed to be supplied was a 17kw cooling 16.3 KW Heating. (straight off the pamphlet). The A/C became no longer available. so they installed a 15.6KW cooling and 16.47KW Heating of another type. The one I was supposed to get could handle 6 zones and the one they gave me could only do 2..so I got a light sitch for the third zone. My house is about 36sq's. It is also not ducted as per BASIX. Would appreciate anyone's knowledge on A/C's and Tribunal experiences. Thanks ps it was a half price deal! never again!!! It says in the contract if they can't supply they are supposed to write to me, which they didnt. My problem is that if it goes to Tribunal and they use a legal eagle..or worse a QC and I loose, I could be up for their expenses as well! I was under the impression that you wouldnt need to worry about legal fees as its a simple tribunal - legal representation isnt necessary and of they choose to, doesnt seem fair that you might have to foot the bill I would ring up the NSW version of VCAT and clarify with them. They usually have a resolution process first before you present the case to the judge. I would personally avoid litigation, it's too much stress and hassle, it's the last recourse. Meantime, I'd appeal to the builder - can you cry on demand? that'll help. I'm sure you can find someone in their organization with the heart to make this good. What brand and model was the 17kW suppose to be and what is the 15.6k model and brand you ended up with? The difference in size is only 1.4kW that's only a small room's worth so that's not too much of a problem. But it is disappointing that they've gone from 6 zones down to 2. Zone motors only cost about $150, then they just need a switch to open and close them. I've got 3 kids, the girls never want the a.c on the boy can't sleep without it, zones is the answer. Both systems will work and what you have is a lot better than not having any air-con but if it was me I'd get the zones and a 2nd controller sorted out.
