Browse Forums Landscape & Garden Design 1 Jun 01, 2011 5:16 pm Hi All, Can anyone offer any assistance in regards to owners rights for trimming a tree that overhangs that boundary when the boundary is with council land? We need to trim the tree to allow the eaves of our new house to be built and I can't afford to wait the 4-6 weeks the council said it will take for them to do it. They didn't offer anymore help, they just said they'll get to it in 4-6. We thought the tree would be a problem but the builder just said we'll play it by ear and see if it interferes. The State is Victoria and the Council if its matters is Maroondah. I'd just like to know if i can cut the tree back to the boundary line. I'll deal with the branches and debris later. I say trim it since its on your side. You are doing them a favour. Make full use of the skills of a trade qualified Arborist. They are very different to a tree lopper or surgeon. There are ways trees are pruned that can result in risky trees. Regrowth can come back in ways that make them likely to cause damage. Or you can have an Arborist do it and avoid that situation. Provided the council has also been consulted. Doing it yourself or with the use of less skilled labour may create the very situation you wish to avoid. DIY, Home Maintenance & Repair Brilliant - thanks so much for that.
