Our build should start within the next month and we had an idea of what we wanted as far as retaining (our block slopes from front to back), but when I went past the other day I noticed our neighbours have put up a small retaining wall on the fence line. Does this mean they have beat us to it and we can no longer put up our wall? Can we fill against their timber wall? If we can't do anything because their wall was there first, shouldn't they have come to us before building it so we could jointly erect a wall that would suit us both? You wish to suit your needs so it will mean you need to construct your retaining wall on your side of the boundary. Remember, the fence line is the boundary. What you do with construction and soil is for you to manage on your block. No one is saying that retaining wall has to go dead on the boundary. Set it back a smidge and achieve what you want. Also have a very decent look at your local councils website which should cover off on boundary laws. My only concern is that since their wall is on the boundary and the fence will be on their wall, if I retain on my side it will create a gap between my wall and the fence that kids could fall down? We are in a new estate and all the other finished houses have only 1 retaining wall between them to a level that suites both sides. Just wondering what people generally do in this situation? Our blocks slope from front to back and they have retained only a matter of metres past their alfresco then stepped it down to meet the natural ground level at the back, we want to retain the whole yard.
