It's a bit line ball who owns it, but the precedent has been set for ownership by council agreeing to pruning twice. Roots and tree trunk have grown into my land. Roots and tree base have uplifted my timber sleeper retaining wall. I wan't to repair the wall, increasing its height to that which is permission under complying development. Using law of abatement, pruning will definitely kill the tree so I can't do that. I can submit a NSW Housing Code Complying Development to do the wall, with the exception that prior permission to remove the tree must be sought. I go to make a prior submission to the local council and they say no – I must submit a DA and the implications are that I must pay cost for removal. Obviously much more work and cost is also required to do the DA. I think this is wrong. I think I should be able to request removal at their cost due to the tree becoming a nuisance and causing loss of amenity. Help please?
