Browse Forums Landscape & Garden Design 1 Dec 04, 2009 4:37 pm Hi Guys, looks like ew have run into an issue with our neighbour over fencing and retaining walls. As we live on a hill and we are slightly higher than they are, they have cut into there block (approx 1.3m below natural ground on the boundary. however we have filled and come up about 600mm, as such there is a 1900mm difference between our yards. To avoid council regulations we both said we would build 1.0m walls, 750mm on the inside of our boundaries, we would then run the fence along the boundary line. That means the walls are 1.5m apart and thus comply with building regulations. it appears though our neighbour has decided to reneg on the deal as when i was at the block yesetrday they have put all the posts in for there wall and they are only 100mm from the fence. therefore to comply we need to build 1.5m back resulting in us losing a lot of our land and our 'side access' Our only other option is we get our wall engineered and council approved to build closer than 1.5m but obviously this is at our expense.. Otherwise we just suck it up and lose the additonal land even though we had a verbal agreement. the same tradesman is doing both walls and he knew the scenario. When i asked him about it he said the neighbour changed it last minute and our neighbour taken it on himself to do that eg. the risk of building closer. What would you do, anyone had similar problem. im worried now if we build our wall where it was oringally planned it doesnt comply and we would be the ones with the issue? The only other way around it is if you had some sort of legal agreement signed by both parties. If it was verbal, then I don't think you have much to back you up. Perhaps there is a rule like that in your local DCP? Interesting...
