We have a cut and fill site where the excavating contractor has extended beyond our boundary by 600mm on the left side of our block. The cut at the highest point extends over a meter.

The SS and the contractor have met and suggest that the best way to deal with this is to use longer posts so that they extend into solid earth, place plim board at the bottom of the fence, fill the neighbours side of the fence and then compact it.
My questions are:
1. Will the long posts and hold the fence and the weight of the soil?
2. Will the soil or fill wash under the fence plim board during a downpour etc. as the fall slopes across the block?
3. Is there a better way of doing this to ensure the fence stays up and the fill added to the neighbours property is retained?
Thanks,
