Browse Forums DIY, Home Maintenance & Repair 1 Feb 13, 2020 5:00 pm HELP PLEASE Hi everyone..i am a female with no idea about building but having issues. We build in 2013 a project home. 3 years later after a heavy storm we had water seep through the upstairs floor onto the carpet about a metre in diameter soaking the carpet. Builder said..oh its a one off let me know if it happens again. Fast forward to last week same issue after that heavy storm in Sydney and not only did the carpet get soaked but downstairs the bathroom window jamb was leaking more like pouring water top and bottom. From what i seem to understand water is leaking down the gyprock wall. Builder is now saying woops sorry your out of warranty and it was a bad storm. What can I do this was an known issue. Why would the water just run down the brick wall and drain away? Oh its a brick veneer home. I’d suggest you call NSW consumer affairs. Your insurer will come and have a look and will likely try to identify the root cause to prevent future problems. They may or may not agree to pay for the rectification themselves. My insurer referred me to VBA. It would be great if it has been extended to 10 years. Is it through VBA ? Re: Water Ingression 7Jun 08, 2020 12:07 am Ozshaz Hi Gaudi I thought the warranty period was always 6 years. Refer to consumer Victoria website for more information Some builders still use quote the 6-7 years. The builder for my house and pergola have both informed me that the warranty is 10 years when we’ve discussed warranty. “Implied warranties apply to all building work. The Building Act 1993 allows action to be brought against a builder for up to 10 years from the date the work was completed. This right transfers to a new owner if the property is sold within this time. For more information, seek legal advice – including if the building work is older than 10 years.” https://www.consumer.vic.gov.au/licensi ... -insurance —————————— There is a difference in the length of time for warranty and for domestic building insurance Domestic building insurance protects consumers in the event that the buider dies, becomes insolvent or disappears, and cannot finish the building project or fix defects.
