I'm usually happy to split the cost for a fence, but since (one of) our neighbours garden bed retaining walls is collapsing it has damaged the common fence. Effectively pushing the fence over into our side of the property. If their retaining wall did not collapse then the fence would still suffice and not cost to either party. So if the retaining wall is holding back your land (with the fence on top of the retaining wall) then you could find you are the responsible party.
