Browse Forums DIY, Home Maintenance & Repair 1 Mar 27, 2010 1:10 pm Our neighbours recently got their driveway redone and in the process of digging up their old one, the builders have managed to crack our driveway. I mentioned this to our neighbour who said at the time he'd follow it up with the builders. It has been over 3 months now, their new driveway is complete while ours remains damaged and their rubbish has been thrown over onto our side. I contact the neighbours again and they claim that it has nothing to do with them, telling me to contact the builders. I confront the builder and he denies to have done the damage, arguing that it was damaged when we took down the fence. I've taken photos of the damage they've done and I have a photo of the driveway in perfect condition even without the fence. Unfortunately, it's not covered by insurance so there's not much I can do there. This brings me onto the next issue. Yes, we also need a new fence, which I've been wanting to and my neighbours got us a quote. All well and good. But they have been putting it off since they've been renovating and such. I've been patient with them. I've been calling them asking when they can get it done, they tell me in two weeks. It's been over a year, still no progress. Just got a call from today, saying they want to get it done asap. But of course, my circumstances have changed with the damaged driveway, which I want to get fixed first and it will probably cost me a fair bit. The neighbours are adamant that the fence has to be done, I asked them to give me two weeks and they refused! I don't think that's fair. They say the driveway has nothing to do with it and they're losing money on their rental property if we done get it fixed right away. Well, honestly, their financial situation isn't my problem either! I think it's very selfish and inconsiderate of them. Any thoughts and advice is much appreciated. Cheers. Re: Damaged driveway- what would you do? 2Mar 27, 2010 1:19 pm Hmmm testy... Well what would happen if you didn't pay for the fence in lew of the driveway? Got any photos of the before and after? Where you are coming from is where you are going to... Re: Damaged driveway- what would you do? 3Mar 28, 2010 12:53 pm Yeah, we've got photos. I'm not sure that not paying for the fence will go down well with the neighbours...they aren't exactly reasonable people. They threatened to give us a 'Notice to Fence' notice from the council since we tried negotiating with them to give us two weeks and they bluntly refused. It's funny since the notice actually says that we get a month to respond to it and it's not like we don't want to redo the fence. So unless they want to follow it up legally, which they can't until a month after we receive the notice and don't give them a reply, the threat is rather benign and gives us another two weeks time. It's hard to comment as the photos area bit dark ( you might need a new 15 - just got one and wow ) Jokes aside, I can see one member that is cracked.
