Browse Forums Outdoor Living 1 Jun 08, 2018 9:09 am Gday folks, Hoping to get some guidance from those who may be familiar with the Builders Code Australia (BCA), as to whether it is possible to achieve variations against the code with regard to minimum boundary setbacks and decking within that area. Currently I am trying to get an owner/builder DA approved to build a deck that runs 50mm from the boundary line, sitting 300 above the finished ground level, along the side of our house. I’ve had a number of conversations with Council, who have advised that it doesn’t conform with their regulations, but that I can submit a variation request for consideration. In seeking further information, they’ve then gone on to cite sections of the BCA which state: - A deck is not permitted as an allowable encroachment under 3.7.1.7(b) whether combustible or not. 3.7.1.7(b) deals with allowable encroachments within the boundary line setbacks, and in reading this it appears to be a slam dunk, in that a deck simply cannot be built in the setback, however in asking Council to clarify that, they have refused to give a direct answer with regard to whether or not it is possible to have variations against the BCA approved. So rather a long winded way of getting to the point. Has anyone had any success in gaining approval to build a deck to the boundary line and/or having variations against the BCA approved? I was going to go to the building appeals board, and also use fire separation material 60:60:60 but draftsman has researched and said I don’t need to. I’ll see if I can work out what information she used that the building surveyor would sign off. We have just installed ours and it is 300mm from the boundary on a small lot, we would rather not make it 900mm and are happy to install 606060 if this would be the solution. What was your solution? Re: Decking to the Boundary Line (NSW) 4Jul 04, 2023 8:20 am I just built a deck in vic on a small boundary lot and had to buid 900mm from side boundary. In vic if your block is under 300qm you have to amend the original house permits. If wanted it 500mm i had to engage a fire engineer or something and if i wanted it on the fence had to build a fire wall againt the fence. Permits.plans set me back 4.5k with my council. In the end builder and I chose just to do 900mm and build a planter box in that space. There was no guarantee engaging a fire engineer would even allow us to build closer without a fire wall. A fire wall would of cost me another 10g plus completely close that side in. There is ways of builder closer will just cost alot more. In WA zero lot is actually zero lot.
