But neighbour wanted Cement Sheeting (Modular fence which cost 5 times more) I agreed and agreed to go half half. We only have agreement through the EMAIL and Chat program (Wechat) that she is ok. Fence been done for 6 months. Now my build also finished. Now she is not willing to pay me for the reasons that the fence is being built NOT to her liking. (gap too big at bottom, which is not the case after I filled up my land with concrete footpath) I did not do up a CONTRIBUTE TO FENCE WORK form from the council website. Does anyone have experience to how to get the neighbour to pay for the half of the cost? it's about $3500 dollars. Thanks for all responses. I'd write her a nice letter/email - setting down what has happened to date. Explain that she is liable for half of the fence. I'd also include a short but firm note that if you do not hear from her by a set date you will be forced to approach the Small claim court. This costs you nothing and you will win in the end - although this may be 6 months away. BUT - keep all paper work and make all communications in writing. Note down any oral communications - date time etc. BUT - initially - be nice and set down what's happened to date. This will be very useful in court. SCC does not use lawyers etc and only relates to smaller amounts of money - eg fences etc. You can even add extra costs (interest, time and travel) into your claim. But - it does take time. They will want you to have mediation etc. We did it and did get satisfaction - although the neighbour never spoke to us again ... I needed the money fairly urgently to help finance a wedding so I wrote out a nice card and bought a flash bottle of red for each neighbour and it did the trick. I understand it is a little different for you as your neighbour has flat out refused and mine were just a little slow but something to consider. Good luck!
