We are currently building our first home, the neighbour on our left is vacant land, our neighbour on the right moved in close to 2 months ago. The land is on a slight hill (hill going up to the right). We did a landscape plan before we started building and it showed a retaining wall would be our responsibility to the left of the house as we will/have raised the land slightly. The land on the left and back it won't be needed. For our neighbour on the right, their house is higher then ours. I understand fence is a shared responsibilty but they say the retaining wall is our responsibility as we are to the left. I thought the fence would be their responsibility as they are raising the land above the natural level. They want to put fill in so that their block is level whereas the natural level of the land is roughly what we need. Who do you believe should be paying and why? I will be calling council eventually just trying to do some research first. I have google searched but get mixed opinions. If it makes any difference I am in NSW.
