Advise? 12Jun 23, 2012 5:43 pm You might want to check exactly what's in your easement and where it's sited before doing anything. If anything you construct causes damage to the assets in the easement, you'd be liable for the cost of repairs. Even building close to an easement can require careful engineering - our house slab had to be piered along the back edge to protect the sewer pipes in the nearby easement. We decided against building a pergola over the easement because of the logistics involved in siting the posts to avoid the pipes (and we'd be unlikely to get council approval for the construction anyway). We've landscaped over it, but the cost and trouble involved in removing soil, mulch and gravel is minimal if the water authority ever requires access to the sewer. A deck probably isn't going to cause problems, but it would be wise to get some expert advice before forking out any money on it.
