Moreover, this 6x6m area should not be facing south or south-west which makes it quite restrictive. On my plans only one location on north side satisfies all criteria for POS (and POS is marked there) but I want to build a pergola attached to the building there. Are you sure you are talking POS or landscaped open space ? With our council ( Warringah ) we are supposed to have 40% landscaped or soft open space and 60sqm of POS for a three bed dwelling ( 36 sqm for a two bedder ) None of that is allowed to be under a roof of any kind although they will give you some leeway ( I think it is up to 25% ) with timber decks for open space. I called them and they said that I can put pergola on that POS area if it is located "to maintain a minimum three hours sunlight onto 50% of the ground of the area between the hours of 9:00am and 3:00pm on 21 June (winter solstice)".
