We are getting a pool and putting a water feature (waterfall) right next to our adjoining fence. When I say 'right next to', I mean practically touching. The waterfall is 800mm in depth and is 1000mm tall. We are actually upgrading our adjoining fence to Colorbond, the standard size being 1800mm tall. This means there will be 800mm above the waterfall to the top of the fence. Is this an issue? Our neighbours don't have a pool, nor do they really have room for one. I know there has to be a zone of 900mm of climable objects but that is from the 'non-pool' side. This is really the only spot for the waterfall so I really hope this is not an issue. If this IS a problem, we can perhaps get a custom size Colorbond fence...does anyone know if Colorbond fence can be custom made to 2200mm? I'm made a few phone calls today and everyone seems to give me different information. One person said that the distance between the top of the water feature and the top of the fence must be 900mm or greater. The next person said that the distance between the top of the water feature and the top of the fence must be 1200mm or greater. The third person said the water feature could be there regardless of heights because it's on the pool side. Then he changed his mind and said, hang on it's the other way around, can't be there at all regardless of height. Bejeezus!!! It seems no one has a clue. Anyone know what the correct answer DEFINITELY is???? Thanks!! PS. I've found out that Colorbond also comes in 2100mm but you need a permit. I know that with our pool inspections, the council have only been concerned about climbable objects near the pool fencing where kids can put their feet through the fencing and use an object to climb over but with a solid colorbond fence this isnt an issue, if they can get over the colorbond fence from the other side they are already on the pool side so I dont see how this would be a problem, but check with your council. I would double check this and ask to speak to the planning dept. It doesn't make sense where there is a solid fence because from the outside it would (presumably) already be 900mm tall from outside the pool area to stop a child getting into the area and that is what pool regs are concerned with. I think the person you spoke to may have been confused with pool fencing and boundary fencing. Like I said, my council who do an inspection every four years have never been concerned with the solid boundary fencing, but if something is too close to the sides which have pool fencing they'll move it or tell us to move it and keep it away from those sides. Do you have a contract with a pool company that includes the water feature? The pool company will know because they are usually the ones that submit the plans. The planning dept usually know their stuff because they are the ones who will approve the application but if you get some bod at the council who just reads the regs and doesnt know how to interpret them or what their intention is, they'll just fob you off with some half baked answer. He wasn't 100% sure either but thought the fence would have to be 1200mm taller than the water feature. So dividing fence would need to be 2.2m. If the council person is right and the fence should be 900mm taller, than the fence would have to be 1.9m. I personally don't get it. As long as there is no climable objects in a 900mm radius on their side of the fence I wouldn't think it matters what I have on mine (especially since the fence is solid). And it looks like there's no problem with me having a water feature in the pool area smack bang against the adjoining fence. Even with a 1200mm fence it would be fine, as I'm using colorbond and there will be no climable fence rails on the outside of the fence (side facing away from pool area) (and also nothing in the non-climable zone). It seems the only time this would be an issue is when the fence uprights are more than 10mm apart. In this case you need to have a clear distance of 300mm on the pool side. With colorbond, this also won't be an issue. The MP 3.4 document can be found here: http://www.dip.qld.gov.au/resources/law ... rriers.pdf This is a direct copy and paste from the document: 6. The non-climbable zone must be located, for a fence, including a boundary fence: (a) less than 1800mm in height - on the outside of the fence (i.e. the side facing away from the pool area); and (b) 1800mm or more in height - on either the outside or the inside of the fence. 11. For barriers 1800mm or more in height, any non-climbable zone on the inside of the barrier (i.e. the side facing into the pool area) may be intersected by a swimming pool barrier, provided the width of the top rail or surface of the intersecting barrier is not more than 50mm wide at any point within the non-climbable zone (see figures 14 (a) & (b)). 13. The dimension of 900mm applies instead of 1000mm and is measured from the top surface of the highest lower horizontal member to the top surface of the lowest upper horizontal member or surface.
