I was just wondering whether I need a building permit or not? The decking size is around 3.5X20m and some will be on the easement. Did ask for a quote and he said I dont need a building permit. I just need to make sure he is telling the truth. I think you get the picture. I rang the council 3 different times to clarify information and got 3 different answers. the main thing to think about is whether or not the deck is physically attached to the house. the answer you wil use is NO!!. this is because if it is attached using a ledger, it can trigger a building permit based on an extension of the house. Here are a few points i hope will clarify your question. 1. The State Building Regs and Act determine what is permisalbe and what is not. In the case of a deck The VIC Building Regs 2006 Schedule 8, item 4 - a - i. as well as part 4 Siting and more! 2. As a rule, anything structural will reqiure a permit. You can come to grief with this one when you sell the house as a potential buyer or their conveyenor may ask for a permit, particularly if the work looks newer than the house. 3. Dont get sucked in to the "under $5000 rule". This doesnt apply any more. 4. Dont rely on council advise, i tell every one CONSULT A PRIVATE BUILDING SURVEYOR. The requirements to do a deck are not onerous and you have the protection of the surveyors consultation and experience. 5. Council may have a specific policy (Melton has one on sheds), but it must be in writing and provided to you. In the case of a deck this is highly unlikely. 6. If you change the footprint of your house in any way shape or form, you can bet you will need a permit. The regs have changed a lot over the last five years and tradespersons who dont keep up with CPD (Continuing Professional Development) can get people in to a lot of hot water. 7. Trying to save a few bucks now can be costly in the long run. Dont let something come back and bite you on the backside in the future. Hope this helps. They didn't even ask the size of it. When they know the decking will have stumps, that's it. Then you need building surveyors to check over the work, prior to pouring concrete to the stumps and after all the joists installed. This appears to be a question often asked on this forum. In many councils views, any structure (and a deck is a structure, regardless of height) over 10m² requires a permit. It does differ, but since yours is considerably larger than this AND is over an easement, it would be prudent to get one. I would make sure your 'decking' tradie has a builders license also, when I was attempting to get my verandah done, I had a lot of people who offered cash, no permit, no license. Simply not worth the hassle, expect the council and draftsman fees to be about $1k. Hi, as per the subject.
