Outdoor kitchen/bbq at lot boundary

We're considering a few updates to our outdoor area and one of the things we'd like to do is set up an outdoor kitchen/bbq area. Ideally we could do this right at the edge of our lot boundary up against the fence (considering sufficient ventilation of course).

The NSW exempt development code however states that you need to stay 45cm away from the lot boundary and that's not ideal in our case. Have people successfully been able to get around this? Thanks!
