Browse Forums Kitchen Corner 1 Apr 09, 2014 8:51 pm Hi all, hoping for some advice - we are about to sign a contact for a new kitchen. After significant negotiation we have finally agreed on everything and have been presented with a contract that requires 50% deposit and the remaining 50% balance paid before delivery. The total sum including install is $30,000 - we feel very uncomfortable about this scenario but are being told this is standard. Wondering what kind of kitchen supply and install (cabinets, bench tops, splashbacks) contracts are considered standard and what payment milestones we should request? many thanks Re: New kitchen - signing a contract and payment milestones 2Apr 09, 2014 10:28 pm Most contracts for domestic work exceeding $20k can only request 5%. Have a look at your state fair trading site and it will give you something to take back to the cabinetmaker. http://camdenbuild.blogspot.com.au/ by invite only please pm me Re: New kitchen - signing a contract and payment milestones 3Apr 09, 2014 11:36 pm they have cleverly separated supply of cabinets (a product being purchased) from Installation (under 20k). As such it doesn't fall in the domestic work over 20k category. I can see both sides of the argument and cant find any evidence to support the idea that the 'supply'of a kitchen should be considered building works Re: New kitchen - signing a contract and payment milestones 6Apr 14, 2014 9:31 pm Never pay the final balance before or upon delivery you will live to regret it. Maybe offer them 40% and the final 10% after completion, that would be the best i would offer. Re: New kitchen - signing a contract and payment milestones 7Apr 15, 2014 7:44 am In NSW by law you are not allowed to take anymore than a 10% deposit for jobs under $20,000 and only 5% if the job exceeds $20,000. You must also have in place a contract that adheres to Fair Trading's rules. They must also give a cooling off period for contracts over $5000 I would not be paying a 50% deposit, it is totally illegal and you could have massive problems. I can understand them asking for a progress payment but there should be a final balance payable of around $4000 once the kitchen is fully finished. If they don't have this payable after installation RUN as fast as you can!
