If the agent is pulling a stunt like that, clearly they dont want you having the benefit of legal advice. That is arrogance of some magnitude right there. There is no excuse for it, so avoid the sale. I would suggest that withholding the contract till the last moment to avoid review, is unconscionable behaviour, and they should be reported to Fair Trading. I have actually asked him for it and he may well respond and provide it (fingers crossed), but what was hideous to me was that the LAW does not require them to provide it any more than 30 minutes before the auction. Most likely it doesnt specify any timeframe for the contract to me made available, hence why old mate there is trying it on. The law doesn't protect you at all a lot of the time, and the more you read on this forum, the more you will learn in that regard. At the end of the day, rules are for fools, and for the guidance of wise men. Use common sense and dont accept conditions if they dont suit you. You and your solicitor should read the contract. You can sometimes even negotiate terms before auction (eg reduced deposit). If the agent doesn't want to give you a contract there's something amiss. I have seen a few properties lately in Sydney that have gone to auction, supply a building and pest report. There is talk of making this law.
