Browse Forums Real Estate 1 Jun 07, 2013 6:02 pm Hi all, We signed with an agent this week and then today found a buyer on our own. Will we still have to pay them commission? They haven't done anything much yet only this morning they took photos, so it's not even online. Originally we agreed on a flat commission of $8.5k and marketing or $1.5k. From what I can gather we may have to pay marketing but do we only pay for what they've done, or the whole lot? Re: Signed with agent and then found our own buyer 2Jun 07, 2013 6:33 pm I would think if you have signed, then yes unfortunately you will. Hopefully not, for your sake though! I had a look at your thread, we are building a Montrose too- hang on though- I got the impression you were building this to live in? Are you selling it already? Our build: viewtopic.php?f=31&t=64705 Re: Signed with agent and then found our own buyer 3Jun 08, 2013 5:08 pm Is it an exclusive contract? Read it and see what it says. If it states they have the right to commission if they introduce clients to your house then you may be OK. Maybe speak to the agent and explain your situation. They may be happy to let you walk away. But if not they can push for commission. Re: Signed with agent and then found our own buyer 4Jun 08, 2013 8:03 pm Well if another agent introduces someone they generally split commission so at worse they have to split it with you 2 Re: Signed with agent and then found our own buyer 5Jun 08, 2013 8:25 pm What about a cooling off period? I spoke to the agent yesterday and they said commission is payable to them no matter what now. Kinda sucks! But I suppose we were happy to pay them to begin with it just feels like they don't deserve it cos they have done nothing Re: Signed with agent and then found our own buyer 7Jun 10, 2013 8:26 pm I would check with you solicitor handling the sale on your end. They may have a way out of it 2 Re: Signed with agent and then found our own buyer 9Jun 11, 2013 7:51 am Yes - check timing of contract and speak with your legal person. There is often a way - even if its splitting the difference. Not much in this responce. My suggestion is, what are you looking to build and why. This will all be impacted by the local councils planning scheme. Familiarise yourself… 6 5863 Can someone please offer some advice? Im DESPERATE. Because I'm completely and utterly exhausted.
