Browse Forums Real Estate 1 Feb 06, 2013 9:00 am Hi, We've had the offer of a house accepted in NSW and are awaiting contract (or sales advice, anything really). We're from WA and are finding purching interstate to be, umm, interesting. It's gotten a little... complicated with the agents. Originally the property was listed with agent A. I'd been in email communication with her some months before we could fly over and inspect. When we got there it turned out that that agent had lost the property and it was now being sold through someone else (a different agency). She still showed us through, but the other agent had to be there as well. Agent A indicated that we should continue to deal through her and most of the subsequent offer process went through her. When we reached our spending cap, she told us the offer was refused and that was that. We weren't going to budge and after waiting a while to see if the seller was likely to change their mind we started looking elsewhere. Now we asked Agent A to let us know if there are any changes with that property and she pretty much said no. We called th other agency (Agency B) and they got back to us within 10 mins to tell us the offer had been accepted. Wha? Agent A has asked for a deposit to be put into her bank, Agency B wants us to deal with them. Any recommendations on what we should do? Can anyone clarify to me what may or may not be going on with comissions etc? Agent A has dome all of the lead up work, but we also feel that she may have been dishonest with us on a few points. My limited understanding of it is that the vendor is the one that may run into issues as they can be liable for 2 x commissions (to each agent). I don't think there is any impact directly on you. But I know in the contract when I purchased there was a clause stating that "the purchaser warrants that they had not been introduced to the property or vendor by any real estate agent other than the vendors agent etc..." I think this is a fairly standard clause but check a copy of the contract. So in your cause the answer to this would be yes. Don't know what would happen if you sign the contract knowing that this is true. You probably need to speak to your solicitor or conveyancer. Hope this is of some help. If the other agent is owed a commission, then it is the responsibility of the seller and their conveyancer/lawyer to deal with it. Land settled May '14. The vendor is liable for the commissions and the agents will fight it out as to who gets what % of the commission. Usually they share it. They will sort it out. Congrats on your purchase. They are the ones working on behalf of the vendor. I would also seriously be questioning if Agent A passed your offers to the vendor.
