My husband and I had signed a contract with an agent to sell out home for a 2 month period ending in Dec last year and with a non-exclusive contract (meaning we did not sign a contract to continue but the agent still had their sign up and was conducting home opens, etc) til Feb this year. We want to try another agency, as we had no luck with our last, and have found an agent we like. Problem is, we have not advised our previous agent in writing that we wish to cancel our contract (which technically expired in Dec 2010) and looking back at our original contract the agent will charge their fee if we sell our house within 160 days of cancellation of this contract with another agent (which would technically be from Monday morning). Has anyone had experience with this? We are concerned as we are not happy with the previous agent but still need to get our house sold. Would love to hear some feed back. I plan on ringing REIWA on Monday too to find out what their stance is. I really hope that we are not stuck with trying to sell our home again with this sub-standard agent Logic will get you from A to B. If you sign with a 2nd Agent and he sells the property, the 1st Agent is legally allowed to charge you a commission fee as well. How did you go at the REIWA?
