It's possible laws vary between states, but IMO that is not what happens in Victoria. We sold our house prior to auction last year, the conditions of the sale were the same as would have prevailed had the property been sold at auction - ie NO conditions. We purchased our current house at auction, we had the building inspection done prior to the auction as it was our understanding that the sale at auction was final and this was our only option re the building inspection. However, if you signed the contract of sale on the day of the auction with the condition written into it, you may be stuck with it as you have now agreed to it. I would be very interested to know the outcome of this. I rang consumer affairs to clarify our position. They have told me that "technically" the house was not sold at auction because it was passed in and negotiations were what got the sale of the home. I think that the buyer is trying to buy some time by putting stipulations into the contract, just because the sale of their own home relies on the sale of ours. Overall though I am unhappy with the agents performance (not just at the auction), the actions at the auction were the icing on the cake and seem just a little murky to me, she tried to get us to set a much lower reserve (which we refused to do) and at this stage we got just short of it (if it comes through), and she did not even find the buyer. My sister asked me today if i'd ever auction again when wanting to sell a home, I told her i'd most likely never sell again, i'd rather burn the place down LOL Thanks for that!
