Browse Forums Real Estate 1 Mar 18, 2010 8:03 pm Hi, i have a contract that doesnt have a settlement date listed, i had been told when settlement was to occur but nothing formally, now a recission notice has been issued as settlement hadnt occured, would'nt the addition of a settlement date require a variation of contract notice to be issued and aggreed to be myself?, I assume that if the contract did have a settlement date it would have required a variation notice to change the date. Re: no settlement date on contract 2Mar 21, 2010 3:34 pm Hi Harlen, I'm not sure if this is relevant. But I've actually never had the settlement date written on the contract. I only get the date of the contract exchange written on it, then the settlement would be the agreed days after the exchange (normally 45 days or similar after exchange). When I last bought properly, my solicitor advised me the exact settlement date in writing, maybe you should check with the solicitor my 0.02 cheers jim Re: no settlement date on contract 3Mar 21, 2010 5:41 pm harlen, where are you located, and what type of property were you buying? Established house, unreleased vacant land....? A bit more info might be helpful. Re: no settlement date on contract 4Mar 27, 2010 7:44 am Hi Harlen, Who is doing the conveyancing on your behalf? Also there should be a real estate agent hot to trot to follow up on settlement! I suggest getting onto your solicitor / conveyancer about this mate You talk about deletions, are they variations or PS and PC adjustments? pleas list them 1 16558 It seems very clear to me that your contract states that a security account does NOT need to be established so the answer to the builder is NO. If in doubt find a contract… 1 8505 10 12308 |
