Then we received an email that the council did not issue a certificate of completion. There were 9 points such as guttering , painting house and other bits and pieces. The vendor wants a clause in the contract that the works will not be completed prior to settlement. They knew about this in June and only informed us after we signed the first copy of the contract on the 29/8. The real estate agent is trying to pressure us to accept an $2000 offer as the person selling can not afford more , you got it at a good price etc etc. What would you do? Is this acceptable? I taught it was done very sneakily to throw this at us just before completion. The kids were already picking out their bed covers! lesson learned do not get emotionally attached until every turns out fine. If anything has been changed on the contract...they added something, they signed a new clause, but you haven't yet..then that contract is now null and void. Anything,,,even an extra comma, ,,,,,,, that they have initialled but you haven't, then it is not in effect. So if you want to go back and add some clauses, ( speak to a good lawyer about what to put in..) do it, and don't give any deposits till it goes unconditional no matter how much the real estate agent wants his deposit ( they get their commission out of the deposit) If you give it now and they don't do the work etc and you then don't buy the house, ...you will be fighting for your deposit for the next 10 yrs!
