HIA building contract

Yes of course the builder can take action against you, you have a signed contact with them, this is a legal document. They can sue you for loss of profit and maybe even copyright if its a similar design.
I'm surprised that the lending institution hasn't said something to you.

Sure, there are a dozen ways to get out of a building contract.
Make sure you get proper advice.
OT I would think lending institutions are getting tired of Builders ripping off Battlers and Punters... while the savings are better off in your pocket

Hi Ash

I am having the same problem now . We want to terminate HIa contract and dont want to build the house at the moment. The builder refuse to terminate the contract instead threaten us that he wil sue us. Can you please share with me were u able to terminate the HIA contract? Did u have to pay for it? How did u manage to get out from the HIA contract.

Thank you for ur suggestion . I had a chat with builder he refuse to terminate the contract n bully to sue me. Do u think fair trading can help me out?



I would suggest you to have chat with builder and explain him . In our case we got termination letter from builder and paid him some certificates cost which he spent, but he helped us as well.
So it’s better to have chat with them and get out of it, if you went to legal advise they gonna rip u off.[/quote]
