Our right hand side Neighbor dug down to build there house by 450mm. Now we need a retaining wall. They put the retaining wall inside there boundary and we put the fence inside our boundary. They want us to pay for the retaining wall that they never discussed with us. We weren’t inform of what kind of retaining wall. When we put the fence, we consulted them. They even pick the colour of the fence. But for the retaining wall. They didn’t discuss with us. Should we pay half of it? The fact that they put the retaining on their side would indicate that it's on them. All of that being said, if the costs aren't crazy and you can bare sharing them, sometimes being prepared to take a hit will win you some good neighbours, though at times you just got to stand up for your rights. There builder build there retaining wall inside there boundary so we put the fence inside our boundary because we don’t want the fence and retaining wall get damage at the same time. They were not happy with what the builder was providing them so they build another one. Now they want share cost. If for example they decided to put a basement on their block the cost of the piers and retaining wall would be on their shoulders. What if let's say they cut the block to go down and you have to fill the block to go up? We would have to agree on the height of the retaining wall here and for their purposes, neighbour can be disagreeable to go for higher retaining wall as they do not really require.
