Browse Forums General Discussion Re: Boundary wall - who owns it? 3Jun 26, 2020 1:46 pm brokenstick I don't know legally, but it would be a dog move from A to try and prevent it IMO. As an aside, there is a house like A down the road from me that has just been completed with a similar setup. Part of the double story is on the boundary. It seems the builder has used any random brick he could find to build the wall facing B, and you can clearly see it from the street and it looks awful. If I was B I would not be happy. Good point.... however.... What if B wanted to paint the wall in a really ugly colour and let’s say this was visible from the street. And would he be allowed to paint the entire wall (ie both stories)? Re: Boundary wall - who owns it? 4Jun 29, 2020 3:29 pm There's no clear definition but it seems only the fencing can be shared, the wall still belongs to A. https://www.disputes.vic.gov.au/information-and-advice/fencing-0 Re: Boundary wall - who owns it? 5Jul 01, 2020 11:34 pm Its not a boundary wall , it's the side of their house. They are normally built 50mm~ in from boundary the line, so you will need permission. If you can't get permission just put a matching fence against the wall. If you owned house A would you like if house B painted the side of you house without permission? Re: Boundary wall - who owns it? 6Jul 02, 2020 11:32 am karcher.cc For the problem below, I've found examples from SA and WA but not VIC, hence I'm starting a new thread. In the sketch below are two houses, owned by A and B respectively. A's house is partially double-storey and sits with its easterly wall on the boundary line (dotted, red) B wants to repaint his side of the fence (northern boundary) AND 'his' side of the boundary wall so that fence and wall have the same colour. The questions is now whether or not he is allowed to do this without A's permission. Does the wall on the boundary belong to A or does it belong to both (each owns one side of it)? Absolutely not.
