I am into a situation where my neighbor who is sitting on a slightly lower house than my upcoming house.
We had shared equally the retaining wall plus fencing cost between us when he was building his house last year.
currently with the cut and fill on my block, the soil level is still below the concrete sleeper level by around 10 cms and less along the fence.
My neighbor wants me to raise the height of retaining and fence before i put the pavers citing pavers will touch the metal part of fence and encroachment to his privacy. And moreover my neighbor is not ready to share the cost.
Just want to know that technically and rule wise, if the soil is sitting below the fence and is below the level where concrete sleepers and fence meet, am I liable for any work to raise the height of retaining plus fence?
Is there any harm if the paver edges touch the fence?
Plus what is the minimum fence height which does not encroach into the privacy of my neighbor..
