Browse Forums General Discussion 1 Jun 17, 2020 10:09 am We had a kitchen/laundry renovation done 3 years ago which involved making the separate kitchen & laundry into one area and expanding into what used to be a under roof rear porch of 2SQM. So we've expanded the exterior wall to take up that porch. We were told we did not require a building permit as all of works was done under the roofline. We own a unit on a block of 3 and after looking at our title I’ve noticed the title shows that the original exterior wall with the 2M x 2M porch notch as the boundary of the unit rather than the roofline. My questions are did I need a building permit and if so can I get a “retrospective” building permit? What would be the steps to get the title updated? I'm based in Kingston VIC. Expect a show cause letter from council. Re: Retrospective Building Permit 5Jun 06, 2021 6:54 pm Hi, (i'm also a building surveyor) In VIC you cannot obtain a retrospective building permit. The only way to legalise the building work is to notify Council who will issue a Building Notice (aka a show cause notice). You can engage a building surveyor to assist you with responding to the Building Notice and justifying to Council why the structure should remain. You normally need exactly the same documentation as if you had applied for a building permit in first place, and you may need to do some opening-up works to confirm how the builder has constructed the structure. I took hundreds of photos along every stage, so hopefully that would minimise the opening up requirements.
