Browse Forums General Discussion 1 Apr 28, 2020 8:46 pm Hi guys, I am new to all this forum stuff so please go easy on me! Im looking for some info on subdividing a block with an existing dwelling. We are looking to eventually demolish and subdivide to build two properties, one mine and my wives and the other her fathers. We went halves in the property, he paid his half cash we got a loan for our half HOWEVER.....as my wife was on maternity leave, he went in on the loan with us so we could get it across the line to secure the property. Meaning he is on the existing loan and the single title. We are renting the place for around another 22 months before demo and building. We need to try and get the block subdivided on paper at least before demo, meaning we receive the second title which he will take over and we can then eject him from our loan (my wife now back at work) so a)we then own our own individual properties b)he can then apply for his loan to build without being on ours and c)we can refinance without him being a participant in our finances. We need that subdivision done ASAP but cannot afford to not have the house rented (tenants are cool with us having surveyors etc around and know our plans). Short question - can I get the subdivision done and get a second title on a property while the existing dwelling remains? In WA you apply for the subdivision and get approval based on criteria being met from different authorities, eg: electrical, sewer, and council. Part of council requirements are for demolition of existing structures on the new block/blocks depending on whether you are keeping an existing dwelling. Once all works are completed then the titles are produced. It was about 8 years ago the last time I subdivided so things may have changed and of course it may be different in SA.
