There is a pile of soil in my backyard (50-60cm cm high) which needs to be removed before I can do the landscaping. But if I remove this pile, the soil from my neighbours house will wash into my backyard from under the fencing. So it will require a retaining wall to stop his side of land mass coming into my backyard. Whose responsibility is that to build such a retaining wall? He is on higher side and I am on lower side? We are in Victoria. From the drawings I could see this soil pile is noted on the builder diagram. Your builder will know. It was a brand-new house but was build by someone else. In the diagram I posted there's a dashed line going from front of the house to the top of where the current soil top level is. Can that dashed line be a representation of the natural land level before the site cut? If so and if you further cut the site to the fence line, you will be responsible for building a suitable retaining wall and bearing the cost of that wall.
