The builder comes up with an adjusted value of the property and requests the buyer to agree to the new amount or the contract will be terminated. What are the rights of the Buyer in this scenario? Re: Off the plan 3Feb 10, 2022 8:46 pm It's a tough one, I'm not sure where you are located, but in Perth here a lot of builders are passing on massive increases even part way through the build an according to the HIA contract is perfectly legal if it's over 5% you can get out of the contract... but not without paying the builder for what work they've done even if they have laid a slab yet.
